TERMS OF SERVICE

1. Introduction and Agreement

These Terms of Service ("Terms") constitute a legally binding agreement between you and House And Land Packages Pty Ltd (ABN 92 631 641 408) ("HALP", "we", "us", or "our"). By accessing or using any of our websites, platforms or services, you agree to be bound by these Terms.

For Advertisers (including agents, builders and developers), these Terms also include the Listing Agreement, which is incorporated by reference. In the event of any inconsistency between these Terms and the Listing Agreement regarding listing specifics, the Listing Agreement shall prevail.

These Terms apply across the HALP network (www.halp.com.au, www.boutiquedevelopments.com.au and associated websites and apps).

By accessing or using our services, you acknowledge that you have read and understood these Terms, agree to be bound by them and our Privacy Policy, represent that you are at least 18 years of age, and represent that you have the authority to enter into this agreement.

We may modify these Terms at any time. We will update the "Last Updated" date, notify registered users via email and prominently display material changes. Continued use after changes constitutes acceptance.

2. Description of Services

HALP operates property discovery and business directory platforms including house and land listings, off-the-plan information, new development details, boutique property showcases, school zone integration, calculators and mortgage broker connections; and business directory services (freemium listings, premium subscriptions, lead generation, business profile management).

HALP is an information and advertising platform. We facilitate connections between property seekers and property providers. We are not a real estate agent, developer, builder or financial advisor.

Property listing inquiries go directly to the listing agent, developer or builder. HALP does not store or process property-specific inquiries. Platform inquiries (Contact Us, Join Us, Advertise With Us) are managed by HALP under our Privacy Policy.

Services are provided "as is" and "as available". We may modify, suspend or discontinue services at any time. Our platform is delivered through Amazon Web Services (hosting and backups), Synergywholesale (domain hosting), Google Workspace, Stripe, Pipedrive, ActiveCampaign and Zapier.

3. User Accounts and Registration

To access certain features you may need to create an account. You must provide accurate information, maintain the confidentiality of your credentials, be at least 18, and (for business accounts) hold a valid ABN or ACN.

You are responsible for all activities under your account. Notify us immediately of any unauthorised access.

We may suspend or terminate accounts that breach these Terms, provide false information, are used for fraudulent activity, fail to pay fees, or remain inactive for extended periods.

4. User Conduct and Prohibited Activities

You agree to comply with all applicable laws, use services for lawful purposes, provide accurate information and respect intellectual property rights.

You must not: use bots/scrapers without authorisation; interfere with platform functionality; attempt unauthorised access; reverse engineer platform components; post false, misleading or harmful content; upload malware; spam; phish; impersonate others; infringe intellectual property; engage in fraud, money laundering or illegal transactions; harass or discriminate against other users; or resell, redistribute, scrape or aggregate our platform without authorisation.

Violations may result in account suspension or termination, content removal, legal action, referral to law enforcement, and permanent bans.

5. Property Listings and Information

Property listings and information are provided and owned by property developers, builders, real estate agents and third-party data providers. HALP does not own third-party listings, verify all listing information, endorse specific properties, or guarantee availability or pricing.

Property information may change without notice. Prices, availability, specifications, images and land sizes are approximate and subject to change. Always verify critical information directly with the property provider.

We disclaim all warranties regarding the accuracy, completeness, currency, availability, fitness for purpose, title, condition or quality of properties.

School zone data is sourced from government databases and third-party providers, provided for general reference only. Always verify catchments directly with the relevant education department and school.

6. Business Directory Listings

To advertise in our business directory you must hold a valid ABN/ACN, be a legitimate operating business, comply with applicable laws and hold necessary licences.

Business listings must accurately describe your services, use current contact information and comply with Australian Consumer Law. Prohibited: illegal goods/services, false claims, professional-code breaches, bait advertising, discrimination or IP infringement.

Free listings offer basic directory presence. Premium subscriptions require monthly or annual payment, are subject to auto-renewal unless cancelled, and follow the refund policy in section 7.

You are responsible for how you use inquiry information and must comply with privacy laws.

We may remove or suspend listings for breach of these Terms, credible complaints, non-payment, unlicensed operation or prohibited content.

7. Payment Terms (Advertiser Subscriptions)

Pricing is as displayed on our website or in the applicable Listing Agreement. Subject to change with 30 days notice. All fees are in AUD, exclusive of GST unless otherwise stated.

Payments are processed via Stripe (PCI-DSS Level 1). Subscriptions auto-renew unless cancelled. Payment failures may result in suspension.

You may cancel anytime before the next billing date. Cancellation takes effect at end of the current billing period. No refunds for voluntary cancellations. Pro-rata refunds may apply for technical issues preventing service access, processed within 14 business days.

Failed payments may result in account suspension after 7 days and listing removal after 14 days. You remain liable for unpaid fees.

8. Intellectual Property Rights

All content and materials on our platforms are owned by HALP or licensed to us, including logos and trademarks ("HALP", "House And Land Packages", "Boutique Developments"), website design, software, text, graphics, images and data compilations.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our platforms for personal, non-commercial purposes. You may not reproduce, distribute, publicly display, modify or create derivative works from our content without permission.

When you submit content (reviews, testimonials, forum posts) you retain ownership but grant us a worldwide, royalty-free license to use, reproduce, modify and display it.

9. Disclaimers and Limitations

HALP does not provide financial, mortgage, investment, legal, tax or real estate advice. Calculators are estimates only. Always consult qualified professionals.

We are not responsible for third-party conduct. Information may contain errors. We do not guarantee continuous availability, error-free operation or absence of malicious code. We are not responsible for failures of third-party services (AWS, Stripe).

10. Limitation of Liability

To the maximum extent permitted by law, HALP and its directors, officers, employees and agents are not liable for direct, indirect, consequential, incidental, special or punitive damages arising from your use of our services or third-party conduct.

Where liability cannot be excluded by law, our total liability is limited to $100 AUD for free services or, for paid services, the amount you paid us in the 12 months prior to the claim or $1,000 AUD, whichever is less.

Nothing excludes consumer guarantees under the Australian Consumer Law. You agree to indemnify HALP against claims arising from your breach of these Terms, violation of law or third-party rights, use of our services, or content you submit.

11. Dispute Resolution

Before initiating legal proceedings, contact legal@halp.com.au and allow 30 days for informal resolution. These Terms are governed by the laws of New South Wales, Australia, with exclusive jurisdiction in NSW courts. Optional arbitration is available in Sydney under the Australian Dispute Resolution Association rules. Class actions are waived to the extent permitted by law.

Property listing inquiries go directly to advertisers — HALP does not store, read or process these inquiries. The advertiser becomes responsible for your information. Platform inquiries (Contact Us, Join Us, Advertise With Us) are managed by HALP per our Privacy Policy.

12. General Provisions

These Terms and our Privacy Policy constitute the entire agreement between you and HALP. If any provision is found invalid, the remainder continues in force. Our failure to enforce a provision does not waive our right to enforce it in future.

You may not assign these Terms without our consent. We may assign them to any affiliate or in connection with a merger or acquisition.

13. Special Terms

Mortgage calculators provide estimates only and do not replace professional financial advice. School zone data is for research purposes only — always verify with education departments and schools; enrolment in a catchment is not guaranteed. Property alerts require your consent; frequency depends on market activity. When we connect you with mortgage brokers we may receive a referral fee or commission — brokers are independent third parties.
